1. Company Details

2. Quotations & Acceptance

All quotations provided by KiKK Groundworks are valid for 30 days from the date of issue. A quotation does not constitute a contract. A contract is formed only when the customer accepts the quotation in writing (including by email) and KiKK Groundworks confirms acceptance. We reserve the right to withdraw or amend any quotation prior to formal acceptance.

3. Scope of Works

The scope of works is as described in the accepted quotation. Any additional works requested by the customer, or required due to unforeseen ground conditions or site circumstances, will be subject to a variation order and additional charges. We will notify you before proceeding with any variation that affects the quoted price.

4. Payment Terms

Payment terms are as specified in the quotation. Unless otherwise agreed in writing, a deposit of up to 50% may be required before works commence. The remaining balance is due upon practical completion of the works. We reserve the right to charge interest on overdue invoices at 8% above the Bank of England base rate under the Late Payment of Commercial Debts Act 1998.

5. Access & Site Conditions

The customer is responsible for ensuring safe and adequate access to the site on the agreed start date. Any delay caused by restricted access, failure to obtain necessary consents, or unforeseen site conditions may result in additional charges and revised completion dates.

6. Planning & Regulatory Compliance

It is the customer's responsibility to obtain all necessary planning permissions, Building Regulations approvals, and any other consents required for the works. KiKK Groundworks will carry out all works in accordance with current Building Regulations and industry standards, but the customer is responsible for ensuring the correct approvals are in place before works commence.

7. Liability & Insurance

KiKK Groundworks carries full public liability insurance. Our liability to you is limited to the value of the contract. We are not liable for indirect or consequential losses arising from our works. We are not responsible for pre-existing conditions, utilities, or structures that are not disclosed to us prior to commencement.

8. Warranties & Defects

KiKK Groundworks warrants that all works will be carried out to a professional standard using appropriate materials. Any defects in workmanship reported within 12 months of practical completion will be rectified free of charge, subject to the defect being caused by our workmanship and not by customer misuse, settlement, or third-party interference.

9. Cancellation

Cancellation by the customer after acceptance of the quotation must be made in writing. Where works have not commenced, any deposit paid may be retained to cover costs incurred (materials ordered, preparatory work). Where works have commenced, the customer will be liable for the value of works completed to date plus any material and plant costs already incurred.

These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
